Terms & Conditions

These Terms govern your use of grytsenko.dev (the "Site"), operated by Dmytro Grytsenko ("I", "me"), and of any software distributed through it. By using the Site you accept these Terms. If you don't agree with them, please stop using the Site.

1. Use of the Site

The Site is a personal portfolio and a support channel for the apps I publish. You may browse it, link to it, and quote short extracts with attribution. You may not:

• use the Site in a way that breaks any applicable law;
• attempt to gain unauthorised access to the Site or its hosting;
• scrape, mirror or republish substantial parts of the Site's content as your own;
• introduce malware, or deliberately overload the Site with automated requests.

2. Intellectual property

All content on the Site — text, layout, design, graphics, source code and the name "Dmytro Grytsenko" — belongs to me or is used with permission, and is protected by copyright and other intellectual property law. Nothing in these Terms transfers any of those rights to you.

Apple, App Store, iPhone, iPad, iOS, Swift, SwiftUI, TestFlight and Xcode are trademarks of Apple Inc., used here for identification only. This Site is not affiliated with, endorsed by, or sponsored by Apple Inc.

3. Apps and separate licences

Apps published under my name are licensed, not sold. Each app downloaded through the App Store is additionally subject to Apple's Licensed Application End User Licence Agreement and the App Store Terms of Service. Where Apple's terms conflict with these Terms in relation to an App Store download, Apple's terms take precedence.

Subject to your compliance with these Terms, you get a personal, non-exclusive, non-transferable, revocable licence to use my apps on devices you own or control. You may not reverse-engineer, decompile, redistribute, rent, sublicense or resell them except where that restriction is prohibited by law.

Each app has its own privacy policy and support page, linked from the app's page on this Site. Purchases, refunds and subscription management are handled by Apple under Apple's terms — I cannot process refunds directly, but I'm happy to help you raise one.

4. Freelance and contract work

Nothing on this Site is an offer to enter into a contract. Rates, scope, deliverables, timelines, intellectual property assignment and payment terms for client work are agreed separately in a written agreement signed by both parties. In the event of a conflict, that agreement prevails over these Terms.

5. Availability

I aim to keep the Site available, but I don't guarantee uninterrupted access. The Site may be suspended, withdrawn or changed at any time without notice. I may also discontinue an app, remove it from sale, or stop maintaining it, subject to any commitments already made to paying customers.

6. Disclaimer

The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Content here is general information, not professional advice — don't rely on it as the sole basis for a technical or business decision.

7. Limitation of liability

To the fullest extent permitted by law, I am not liable for indirect, incidental, special or consequential loss, nor for loss of profit, revenue, data or business, arising from your use of the Site or of any app. My total aggregate liability arising out of or in connection with the Site is limited to the greater of the amount you paid me in the twelve months before the claim, or EUR 100.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.

8. Third-party links

Links to external sites are provided for convenience. I don't control them, don't endorse them by linking, and accept no responsibility for their content or practices.

9. Privacy

Personal data is handled as described in the Privacy Policy, which forms part of these Terms.

10. Changes to these Terms

These Terms may be revised. The "Last updated" date above reflects the current version, and the version in force when you use the Site is the one that applies.

11. Governing law

These Terms and any dispute arising from them are governed by the laws of Ukraine, and the courts of Ukraine have exclusive jurisdiction. If you are a consumer resident in the EEA or the UK, you keep the protection of the mandatory consumer-law provisions of your country of residence and may bring proceedings there.

12. General

If any provision of these Terms is held unenforceable, the rest stays in force. My failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and any signed agreement between us, are the entire agreement on this subject.
